This is just too much. A man is suing apple because the iPod might cause hearing loss. That's right, he is not suing because it did cause his hearing loss, but because it might cause it in the future.

Patterson does not know if the device has damaged his hearing, said his attorney, Steve W. Berman, of Seattle. But that's beside the point of the lawsuit, which takes issue with the potential the iPod has to cause irreparable hearing loss, Berman said.

Things like this almost make me believe Social Darwinism is justified.

I've met writing implements that could cause irreparable hearing loss. Should I sue PaperMate?

Shouldn't he also, in the spirit consistency, be suing Sony for making walkmans? (walkmen? I've never been sure.) Along with any headphone manufacturer--because really, it's not the iPod, it's the headphones. All an iPod by itself can do is make little clicky noises.

Seriously though? Words fail me. Maybe that's just because I was up till 2 am writing a paper, but stories like that make me unable to do anything but stare blankly at the computer screen and sputter.

Never you fear, Thursday. Predicting from law school nostalgia, this case will simply not happen. Torts require some sort of concrete damages, but if the judge accepts this case (which he shouldnt) its because there is some sort of grand policy to be derived from it, qua a needed contribution in the US Common Law... I have a great faith in stare decesis. All that to say, no need to worry too much. Civil procedure is there for you!
